International legal acts concerning personal data protection

Interest in the issues of personal data protection in an international aspect occurred in the second half of the 20th century. It was connected with increasing economical development and necessity of data flows between co-operating countries, including the flows carried out by computer network. However, there was no legal act which would wholly regulate the issues concerned. Whereas in the legal act issued under the auspices of the United Nations there are certain fragmentary regulations connected with this issue, however they concern rather the protection of privacy than the protection of data sensu stricto.

Universal Declaration of UNESCO on the Human Genome and Human Rights

The Universal Declaration of November 11, 1997 on the Human Genome and Human Rights is a document of universal nature. Pursuant to its assumptions genetic data associated with an identifiable person must be held confidential (Article 7). As it results form the content of the act such protection covers all genetic data regardless of the purposes of their collection. Collection of such data for research purposes was pointed out as an instance. Limitation of the above principle may only be prescribed by law.

Concerning Guidelines for the Regulation of Computerised Personal Data
On June 26, 1985 under the patronage of the United Nations Human Rights Commission a draft guidelines concerning regulations pertaining to electronic data banks containing amongst others personal data were prepared. This paper was adopted in 1988 and declared on December 14, 1990 as a resolution containing guidelines for the regulation of computerised personal data files. The above guidelines do not have binding force. They are only recommendations pertaining to guarantees which should be provided for in national legislation in the field of computerised processing of personal data. This resolution is based on several simple principles (lawfulness and fairness, accuracy, purpose-specification, interested-person access, non-discrimination and security) which should be introduced into national legislation.

Recommendation of the OECD Council of September 23, 1980 Concerning Guidelines Governing the Protection of Privacy and Transborder Flows of Personal Data

Recommendation of the Organisation for Economic Co-operation and Development (OECD) of September 23, 1980 concerning guidelines governing the protection of privacy and transmission of data between countries is not a document having a binding force. These are only guidelines of the OECD Council pertaining to regulations concerning the protection of privacy and transborder flows of personal data contained in national legislations. A significance and influence of international data transfer on the world economic development and negative influence of limitations in this regard is stressed in the above guidelines. Recommendation in its guidelines allows for introduction of such limitations in national legislations, however it recommends elimination of such limitations.

Resolution 34/169 adopted by the UN General Assembly

Concerning the Code of Conduct for Law Enforcement Officers (in particular article IV)
Resolution 34/169 of 1979 “Code of Conduct for Law Enforcement Officials” raises (in a narrow scope) in Article IV issues concerning questions of personal data protection. It is only a recommendation for officials who, by the nature of their duties, obtain personal data of other persons pertaining to proceeding with these data. The data may be disclosed only for the purposes of realisation of official duties and for the purposes of jurisdiction.
