Opinion of the Article 29 Working Party (WP 110)
During the recent meeting of the Article 29 Working Party organised on 22-23 June 2005 the working party adopted a working document WP 110 containing an opinion on the Proposal for a Regulation of the European Parliament and of the Council concerning the Visa Information System (VIS) and the exchange of data between Member States on short stay-visas.
27th International Conference
27th International Conference of Data Protection and Privacy Commissioners Montreux (14 – 16 September 2005)
Dr. Ewa Kulesza, the Inspector General for Personal Data Protection, participated in 27th International Conference of Data Protection and Privacy Commissioners, held in Montreux (Switzerland) on 14 - 16 September 2005. The Conference is the most important, annual meeting of the representatives of the data protection authorities from all over the globe, as well as the representatives of the Council of Europe and the European Commission. In Conference also participated the representatives from the world of science, industry, as well as governmental and non-governmental organizations.

The Conference was divided into two parts. During the open sessions, representatives from the world of business, science, industry and governmental and non-governmental organizations debated together with data protection and privacy commissioners from over 40 countries on the role of the right to data protection and privacy in a globalised world. During the Conference Dr. Ewa Kulesza led the session on the role of the private sector in data processing to fulfil public tasks.

On September 16 the International Closed Session of Data Protection and Privacy Commissioners took place. At this session among others the two following resolutions were adopted:
  • On the use of biometric data in passports, ID cards and travel documents, as well as
  • On the use of personal data for political communication purposes.

New documents of the Article 29 Working Party
On the website of the Article 29 Working Party there are new documents available. These documents pertain to: the results of the public consultation on Article 29 Working Document 105 on Data Protection Issues Related to RFID Technology (WP 111), the opinion on implementing the Council Regulation (EC) No 2252/2004 of 13 December 2004 on standards for security features and biometrics in passports and travel documents issued by Member States (WP 112), the opinion on the Proposal for a Directive of the European Parliament and of the Council on the Retention of Data Processed in Connection with the Provision of Public Electronic Communication Services and Amending Directive 2002/58/EC (WP 113) and the opinion on the Proposals for a Regulation of the European Parliament and of the Council and a Council Decision on the establishment, operation and use of the second generation Schengen information system (SIS II) and a Proposal for a Regulation of the European Parliament and of the Council regarding access to the second generation Schengen Information System (SIS II) by the services in the Member States responsible for issuing vehicle registration certificates (WP 116).
The Schengen Information System – evaluation missions
Polish data protection authority is undergoing an evaluation of the level of implementation of the Schengen Acquis. Such missions are organised every 5 years. They comprise both states participating in the Schengen co-operation as well as states candidate to such co-operation. The said missions have a particular meaning for the latter group of states as a positive outcome of evaluation is the condition of joining those states to the Schengen Information System and abolition of checks on common borders.
Article 29 Working Party document – WP 117
Article 29 Working Party has adopted an opinion on the application of EU data protection rules to internal whistleblowing schemes in the fields of accounting, internal accounting controls, auditing matters, fight against bribery, banking and financial crime. This document concerning the impact of the US Act Sarbanes-Oxley on data protection is available on the website of the Working Party.
Article 29 Working Party Document – WP 119
Article 29 Working Party has adopted opinion 3/2006 on the Directive 2006/XX/EC of the European Parliament and of the Council on the retention of data processed in connection with the provision of public electronic communication services and amending Directive 2002/58/EC, as adopted by the Council on 21 February 2006. This document is available on the website of the Working Party.
