Consultations on changes in the Labour Code

Michał Serzycki, the Inspector General for Personal Data Protection launched consultations on changes which have to be introduced in the Labour Code in the context of personal data protection, so as to strike a balance between the interests of both parties of the employment relationship.

In connection with the information received by GIODO on the applicable provisions of the labour law not being adapted either to the needs of employers or employees, Michał Serzycki turned to various milieus with a request for opinion on directions of essential changes in the context of personal data protection and the right to privacy.

Having analysed the scope of personal data collected by employers, the Inspector General stated that public debate on this subject was necessary. GIODO used to initiate such discussions in the past, among others during scientific conferences such as „The boundaries of personal data protection in employment relationships” organised by GIODO with the Law College of Leon Ko1minski Academy or on the occasion of discussions in the media.

Currently, Michał Serzycki has requested remarks in this matter from organisations of employers and employees, institutions dealing with human rights protection as well as representatives of the science world. In his correspondence addressed to them he emphasised the need to introduce such legal regulations which would balance the interests of both parties of the employment relationship, i.e. will ensure proper control over employees to employers and will guarantee the right to privacy protection to employees.

After having analysed the opinions received this way, GIODO is going to turn to competent authorities with legislative initiative with a proposal of changes in the labour law related provisions.
