
The Inspector General for Personal Data Protection (GIODO) decided to deal ex officio with the new terms of service of nasza-klasa social networking site.
The Inspector General, performing his competences under the Data Protection Act, analyses the terms of service related to the processing of users’ personal data. The final evaluation of compliance of the new terms with data protection principles will be possible upon the completion of the analysis.
If the users find that terms of service contain illicit provisions, they should notify the service provider of that fact, and if the latter fails to take it into consideration – they may apply to a common court to deem the provision in question null and void. In order to do so, they may seek assistance of the county of municipal or district consumer ombudsman who – under Article 42 sections 1 and 2 of the Act of 16 February 2007 on competition and consumer protection provide free of charge consumer advice and legal information in the scope of protection of consumer interests and may bring an action on consumers’ behalf and, with their consent, join lawsuits in cases concerning protection of consumer interests.
