In writing

Essential elements of a complaint filed in writing are as follows:

  • elements identifying a person filing a complaint (a complainant) such as:
    • name and surname/entity’s full name,
    • address of residence / seat.
    CAUTION! If a person files a complaint on behalf and for the benefit of another person (acts as a proxy of another person), he/she shall be additionally obliged (except for giving the above mentioned information identifying him or her) to:
    • indicate information identifying a person whom he/she represents – i.e. the person’s name, surname and address,
    • enclose to the complaint an original or a certified copy of a document authorising him/her to act on behalf and for the benefit of a principal in a proceedings before the Inspector General for Personal Data Protection,
  • description of case circumstances – i.e. description of circumstances which became grounds for filing a complaint, along with unambiguous indication of an entity/ a person whom the complaint concerns (by giving full name and address of seat/residence of the data controller) as well as indication of activities expected by the complainant to be undertaken by the Inspector General for Personal Data Protection,
  • personal signature of the complainant.

A complaint in written form can be submitted by:

  • sending it to the Bureau of the Inspector General for Personal Data Protection by post (to the address: Biuro Generalnego Inspektora Ochrony Danych Osobowych, ul. Stawki 2, 00 - 193 Warszawa),
  • "submitting it in person in the Bureau of the Inspector General for Personal Data Protection (address as above).

ATTENTION! Although it is admissible to submit a complaint by sending it by fax (fax no.: +48 22 860-70-86), there are no grounds for recognition of the letter sent this way as personally signed. Such letter is thus treated as lacking personal signature. In such case a complaint accompanied by personal signature has to be sent also by post or a complainant has to appear in person in the Bureau of the Inspector General for Personal Data Protection and put his/her personal signature on the complaint.
