Directives

Directives are directed to Member States exclusively. They do not state any rights or obligations for private and natural persons. The State is obliged to implement the requirements of directives in its national legislation; it needs to be stressed that the form of implementation is indifferent. Therefore directives do not belong to self-executing law. Directives can be applied directly only in case where the term to implement the directive has elapsed and the Member State did not implement them or the implementation is defective.

Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.
